10a. Rates of pay, whether any dates are night shoots as well as the Agent’s commission and ’The Lynch Mob Agency' administration fee for any role will be stated on the availability check or brief for the role. This is the Artist's opportunity to decline a role if the Artist does not accept the terms offered. For the avoidance of doubt after the Artist has made themselves available for a role the Artist is not entitled to be released on the basis of the rate of pay.
10b. Due to the nature of film or TV productions, the exact location and call time (the start time) for each date of an engagement will not usually be known until the evening before a shoot date. Likewise, due to the nature of filming it is not possible to know before hand how long a shoot day or night will go on for. Therefore, it is of crucial importance that the Artist when pencilled or confirmed, keep the entire day(s) (or night(s) for night shoots) free to allow for both early call times and late finish times.
10c. The Artist acknowledges that the Agent will be entitled to commission for success fully placing the Artist in work on an engagement. The rate of commission will vary, but will at most be 15% (plus applicable VAT) of the total amount paid by the Hirer for each engagement. The Artist will be advised of the level of commission by the Agent when a role is offered.
10d. The Lynch Mob Agency shall charge the Artist an administration fee which is payable in respect of each engagement successfully placed via our system, which, together with any commission due to the Agent, is part of (and deducted from) the payment to The Lynch Mob Agency by the Hirer for each engagement (such payment deemed to include the Artist's fee plus, the administration fee, the Agent’s commission and applicable VAT on the same).
10e. The standard rate of The Lynch Mob Agency administration fee is 10% (plus applicable VAT) of the total amount paid by the Client for each engagement, but a lower rate of administration fee may apply for certain engagements. If a lower rate applies, the Artist will be advised of it before accepting the engagement
11. You accept that from January 1st 2013 we will charge a sum of money £43.50 increasing to £61.50 from January 1st 2015 annually to appear on our website and in our casting submissions. You will have a period of 30 days, after we advise you of the information to be included, to object. If you so object you should inform us in writing immediately and your information will not be included or available for production companies to see and you will not be charged the fee. If you have no objections then the annual fee will be taken in from the first paid jobs we obtain for you. Alternatively you may pay the fee in full directly to us. Once paid fees are non refundable unless under specific per-agreed circumstances.
11a. The end user of the our services is the supporting artist and the client of the agency is usually a production company, looking to book artists for a project. The client is not a party to this contract and the terms of the relationship between any Supporting Artist or Agent on the one hand and any client and the agent on the other relating to a particular engagement are governed by separate agreement between them the terms of which, in the case of the terms agreed between the client and The Lynch Mob Agency,
12. At the end of each year any outstanding fees due will be written off but a new fee for the following year will become due as above.
12a. The Artist hereby grants The Lynch Mob Agency the exclusive authority to receive money on its behalf for all engagements agreed via any Agent with any Hirer and for us to use reasonable endeavours to collect the same. The Artist agrees to appoint The Lynch Mob as the Artist's agent to collect the same and to provide such information and cooperation as The Lynch Mob Agency or the Agent shall reasonably require to collect the same and to authorise The Lynch Mob Agency to incur costs in relation to such collection if legal action is in The Lynch Mob Agency reasonable opinion necessary in order to collect the same and worthwhile (the reasonable and properly incurred costs of such action being payable by the Artist out of any sum The Lynch Mob Agency recovers on the Artist's behalf). For the avoidance of doubt, if The Lynch Mob Agency incurs any such costs and they exceed the amount of money recovered from the Hirer the Artist will have no liability whatsoever to The Lynch Mob Agency for the excess amount.
12b. The Agent will invoice hirers weekly and The Lynch Mob Agency aims for all payments to be received within 4 to 8 weeks of the relevant engagement. The Lynch Mob Agency is not able to provide individual updates on payments until 8 weeks have passed since the date of the engagement. In no circumstances should a artist talk about our business to the client in terms of obtaining any work, fees, commissions, call time, locations either on set of once filming is finished for up to 3 years later Anyone found to be in breach of this clause will be dismissed immediately.
12c. As a self-employed worker, it is the Artist’s responsibility to declare his or her earnings to HMRC and other relevant tax authorities. The Lynch Mob Agency cannot offer any advice on any individual tax situation.
